"ข้อ 27 อำนาจหน้าที่ทางราชการนั้นไม่เป็นประเด็น
1. ธรรมนูญนี้ให้ใช้บังคับแก่บุคคลทั้งปวงอย่างเท่าเทียมกัน โดยปราศจากข้อแตกต่างใด ๆ เพราะเหตุแห่งอำนาจหน้าที่ทางราชการ โดยเฉพาะอย่างยิ่ง อำนาจหน้าที่ทางราชการในฐานะประมุขแห่งรัฐหรือรัฐบาล สมาชิกรัฐบาลหรือรัฐสภา ผู้แทนราษฎรซึ่งมาจากการเลือกตั้ง หรือข้าราชการนั้น ย่อมไม่เป็นเครื่องคุ้มบุคคลให้พ้นจากความรับผิดชอบทางอาญาตามธรรมนูญนี้ กับทั้งไม่เป็นเหตุสำหรับลดโทษอยู่ในตัว ไม่ว่าในกรณีใดก็ตาม
2. ความคุ้มกันก็ดี หรือระเบียบวิธีสบัญญัติพิเศษก็ดี ซึ่งอาจยังให้บุคคลเกิดมีอำนาจหน้าที่ทางราชการ ไม่ว่าตามกฎหมายภายในประเทศหรือระหว่างประเทศนั้น ย่อมไม่เป็นที่กีดกันศาลมิให้ใช้อำนาจชำระบุคคลเช่นว่า
Article 27 of the Rome Statute:
"Article 27 Irrelevance of official capacity
1. This Statute shall apply equally to all persons without any distinction based on official capacity. In particular, official capacity as a Head of State or Government, a member of a Government or parliament, an elected representative or a government official shall in no case exempt a person from criminal responsibility under this Statute, nor shall it, in and of itself, constitute a ground for reduction of sentence.
2. Immunities or special procedural rules which may attach to the official capacity of a person, whether under national or international law, shall not bar the Court from exercising its jurisdiction over such a person.
